1. Acceptance of Terms
Welcome to FreewayPTT. By accessing or using any part of the FreewayPTT services, websites, or applications (collectively, the "Service"), you agree to comply with and be legally bound by the terms and conditions contained in these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
FreewayPTT provides advanced communication solutions including voice, text, GPS tracking, and managerial tools through its platform. The Service is accessible via web interfaces, mobile applications, and specialized communication devices. We reserve the right to modify or discontinue the Service (or any part thereof) at any time without notice.
3. Eligibility
To use the Service, you must be at least 18 years old or have obtained parental or guardian consent. By using the Service, you represent and warrant that you meet these eligibility requirements. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
4. User Accounts
You must create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify FreewayPTT immediately of any unauthorized use of your account or any other breach of security.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You are prohibited from using the Service to engage in any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable conduct. FreewayPTT reserves the right to monitor your use of the Service to ensure compliance with these Terms.
6. Intellectual Property
All content provided on the Service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of FreewayPTT or its licensors and is protected by international copyright laws. You may not modify, reproduce, distribute, create derivative works of, publicly display, or otherwise exploit any content without the prior written consent of FreewayPTT.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.
8. Limitation of Liability
To the fullest extent permitted by law, FreewayPTT shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the Service, even if FreewayPTT has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above exclusions and limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless FreewayPTT, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Service or your violation of these Terms.
10. Termination
FreewayPTT reserves the right, in its sole discretion, to terminate or suspend your account and access to the Service, with or without notice, for any reason, including but not limited to your breach of these Terms. Upon termination, your right to use the Service will immediately cease.
11. Changes to Terms
FreewayPTT reserves the right to modify these Terms at any time. We will provide notice of such changes by posting the updated Terms on our website. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically.
12. Governing Law
These Terms and any disputes relating to these Terms or the Service will be governed by and construed in accordance with the laws of The Province of British Columbia, Canada, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in The Province of British Columbia, Canada for the resolution of any disputes.
13. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.
